Last Friday, 14 November 2025, ECLA held its 52nd General Assembly at the renowned National and Kapodistrian University of Athens in Greece, following the invitation of our Greek member association – ΈΝΩΣΗ ΕΜΜΙΣΘΩΝ ΔΙΚΗΓΟΡΩΝ (GILA). The representatives of all 24 ECLA member associations 🇪🇺 discussed the current situation of in-house lawyers in Europe and the next milestones of our association in the coming years.

Energetic speeches on the rule of law, professional challenges and opportunities enriched the discussion through our the day, especially by:

ECLA commemorates the 25th anniversary of our Belgian member association IBJ-IJE

For 25 years the Institute represents and protects the interests of the profession in general and of the company lawyer in particular. Through the institute more than 2 400 company lawyers in Belgium have a protected title and their legal advice to their employer is confidential. At IBJ/IJE Belgian company lawyers are subject to their own professional code of ethics, which guarantees their intellectual independence and continued training.

We congratulate for hosting such an outstanding and memorable festivity in the Skyhall of Brussels airport with 800+ registered participants, key-note speeches by the president of IBJ/IJE Nicolas ISTAS, and the minister of justice in Belgium Annelies Verlinden. PRESS RELEASE: Impartiality of the Legal System Targeted: A Threat to the Rule of Law

Brussels, 19 March 2025

The European Company Lawyers Association (ECLA), representing the interests of the approx. 160.000 in-house legal professionals across Europe, expresses deep concern over recent executive orders by the current U.S. administration targeting law firms based on their client representations. These actions include the revocation of security clearances and the termination of federal contracts for law firms that represent parties against the government.

Furthermore, ECLA sides with the American Bar Association (ABA) and the chief justice of the U.S. Supreme Court in criticizing recent efforts to intimidate judges, by calling for the impeachment of judges simply because they do not rule as the government desires.

Law firms, legal professionals and judges play a vital role in ensuring access to justice and upholding the integrity of legal systems. The ability of lawyers to represent clients – regardless of political affiliations – and judges to make rulings based on their oaths to only follow the law, without fear of government retaliation is a cornerstone of democratic societies.

These unprecedented measures against law firms and judges pose a significant threat to the fundamental principles of legal independence, impartiality, public trust, attorney-client privilege, access to justice, the rule of law, and democratic legal systems.

ECLA stands in solidarity with the broader legal community in denouncing any interference that compromises the independence of legal practitioners and therefore infringes the democratic principle of the separation of powers. At a time when the global legal framework faces increasing pressures, it is crucial that we collectively uphold the core values of justice, fairness, and autonomy in jurisprudence. ECLA remains committed to safeguarding these principles and supporting all efforts to preserve the integrity of the legal profession and the rule of law.

ECLA/ICAM – Legal Professional Privilege Workshop

High-level expert workshop 💡 with colleagues from across Europe 🇪🇺 and the European Commission on the evolution of our profession …

On Friday, 14 March 2025, 40 experts on the legal professions, including in-house lawyers and the European Commission met in Madrid, Spain 🇪🇸 to discuss the latest developments and challenges for attorney-client-confidentiality, professional secrecy and legal professional privilege at large. The focus was on national developments since the well-known Akzo Nobel decision both in Europe and other OECD countries, the currently pending case at the Court of Justice of the European Union on the transposition of the whistleblower directive, and future developments on the legal profession.

Main conclusions and key take-aways:
⚖️ The legal profession must take a more active role in defending professional secrecy and recognizing it as an essential right of citizens
⚖️ The profession evolved significantly since the year 2010 and most probably a decision like the one in the Akzo Nobel case would not be possible today
⚖️ Thus the Akzo Nobel jurisprudence needs to be revisited to reflect the current standards of the in-house legal profession today
⚖️ Today, the majority of Member States of the EU guarantee some sort of confidentiality to in-house counsel
⚖️ Trust is key for a transparent communication between in-house legal departments and the internal client
⚖️ Therefore, confidentiality in the communication with in-house counsel supports effective compliance structures across Europe
⚖️ Terminology upgrade: It is not the legal privilege of the lawyers, it is a privilege of the client and therefore an obligation for the lawyers (There is an obligation arising from the privilege)

ECLA President and General Manager Speak at ELTACon

Stephanie Fougou, President of ECLA and Marcus M. Schmitt, General Manager, spoke at the ELTACon in Paris, France last week focussing on the changing legal landscape…

The conference title ‘ReshAIping the Legal Landscape’ clearly gave the focus topic away. Stephanie was part of the opening panel ‘Legal Titans: How Will Large Legal Players Reshape the Legal Landscape in the AI Era?’ together with Isabel Parker, Caroline Hill and Grégoire Miot.

Marcus elaborated on the ‘evolving profession’ and the ‘highly diverse legal tech and legal operations landscape in Europe’ as part of the closing keynote panel together with Ana-Maria Drăgănuță Briard, Bradley Collins, Christiana Aristidou and Konstantinos P. Anagnostopoulos.

Legal Artificial Intelligence (L-AI) will be one of ECLA’s top-focus for the year 2025 with interesting opportunities for best-practice-sharing, networking possibilities, and continuous professional development events. Stay tuned!!!

Stéphanie Fougou Elected President of ECLA

ECLA is pleased to announce the election of Ms. Stéphanie Fougou, SVP, General Counsel and Board Secretary at Technicolor Group SA, as its new president, effective immediately. This transition marks a significant milestone in the association’s history as it continues to advance its mission of strengthening the corporate legal profession across Europe.

Ms. Fougou brings a wealth of experience to the role, with a decades-long background in legal leadership positions at Executive Committee level. She is the first woman to serve as president of the association. Under her stewardship, ECLA will continue growing the representation and promotion of the profession at both European and at international levels, while further building relationships with existing organisations whose goals are aligned. Furthermore, she particularly aims to target contemporary legal and regulatory challenges and enable ECLA to provide increased value to corporate lawyers across Europe.

Comments from Leadership

“I am honoured to take on this role and continue the great work that ECLA has already done.” said Ms. Fougou. “My primary goal will be to enable ECLA to act as the European relay for national corporate lawyer associations and provide increased value to company lawyers across Europe. As an umbrella association, ECLA will strive to become both a lightning rod for regulatory and other advocacy-related challenges and act as an information and networking hub for all corporate lawyers based in Europe, among which the reflexions about the future of Corporate In-House Lawyers facing IA challenges and the CSR systemic litigation risks for companies. I look forward to collaborating with all our 22 member associations and stakeholders to achieve our objectives and with our 6 additional board members.”

Her tenure starts at a challenging time, as both geopolitical challenges and technological advancements have significantly impacted legal work in recent years. ECLA’s outgoing President Jonathan Marsh has been elected honorary president of the association, and commented as follows: “Current challenges require leadership to be both sharp and experienced in leading legal departments and advocating for the profession. I am delighted that our beloved association gains such an industry titan to steer us through the unknown. I am excited to see how ECLA will evolve further.”

Stephanie Fougou will serve as the 17th president of the association. She has been elected for a 2-year term which will last until Spring 2026

The 49th General Assembly just elected Stephanie Fougou (Director Legal, VP, Ex-Com member Technicolor Group) as the first ever female president in the 41 years of ECLA’s history. She follows Jonathan Marsh after his 8 years of presidency. Stephanie announced that she would continue on the successful path of ECLA of advocating for the in-house legal profession, offering a vital European network for knowledge transfer and assisting our profession in the ongoing transformation.

The General Assembly also elected Laure Lavorel (Senior Associate General Counsel at Broadcom) into the Executive Board as one of the four Vice Presidents of ECLA together with Mark Cockerill, Silvia Bonacossa, Waldemar Koper, as well as Eric Lennerth as Treasurer and Stéphane BARTHE as Secretary. Laure will support ECLA with her outstanding international network and experience.

Jonathan Marsh was elected Honorary President of the association and will continue advising the Executive Board.

The General Assembly also thanked Didier Pissoort of Belgium for his 41 years of service as ECLA Auditor.

ECLA & ACC joint feedback on the 2021 EU Justice Scoreboard

[vc_row css_animation=”” row_type=”row” use_row_as_full_screen_section=”no” type=”full_width” angled_section=”no” text_align=”left” background_image_as_pattern=”without_pattern”][vc_column][vc_empty_space height=”20px”][vc_column_text]On 8 April 2021, ECLA and ACC jointly submitted their feedback form on the 2021 EU Justice Scoreboard. Both associations welcomed the consultation on the Scoreboard and its broadened scope to support the achievements of the European Semester and the implementation of the Recovery and Resilience Facility. As noted in the form, by including in-house lawyers as a distinct category of justice stakeholders, the European Commission will gain a more precise picture of the state of the rule of law.

It should be noted that the viewpoints of in-house lawyers may have been included in past scoreboards in cases where company lawyers are full members of the bar. For example, French in-house counsel cannot join the national bar association, which entails that they have been excluded from the scoreboard figures of the past. Because of these national differences, the associations recommend adding the following research themes to the 2021 Justice Scoreboard:

a) the role of in-house counsel in promoting a culture of compliance within their companies;
b) the role of in-house counsel as officers of the court in the administration of justice,
independence of in-house counsel, and their relationship with legal privilege; and
c) the contribution in-house counsel to the efficiency of justice by resolving issues cooperatively
and effectively before they reach litigation, thus reducing pressure on the judicial system.
d) Collect data on the number of in-house counsel in each country of the European Union in order
to measure capacity to comply and promote the rule of law in the private sector.

In-house legal departments are uniquely positioned to promote an efficient administration of justice, by contributing to effective dispute resolution solutions and enforcement, while reducing recourse to judicial resources and, importantly, before the need for litigation arises. Moreover, in-house legal departments increase access to justice by lowering the hurdles of obtaining legal advice – an issue of particular relevance and key to global competition, especially for small and medium enterprises.

On 26 November 2020, the General Assembly of the European Company Lawyers Association decided to re-elect Jonathan Marsh as President and Giovanni Cerutti as Treasurer of ECLA, respectively. The unanimous decision for both individuals, with twenty member associations from ECLA’s pan-European network voting in favour for the two candidates marks their third consecutive terms as members of the ECLA Executive Board.

The unanimous re-election for Jonathan Marsh as President was strongly tied to the increased activeness that ECLA has displayed under his tenure. The association today provides an increasingly diverse set of services for the benefit of its twenty-two member associations, ranging from hosting physical and virtual events to publishing research publications, in addition to presenting opinions in landmark cases related to the core values of ECLA.

For Giovanni Cerutti, the financial security and diligence that the Association has shown towards its commitments over the years supported his re-election as Treasurer.

Jonathan Marsh currently serves as International General Counsel of the Marketing Services Division of the Total S.A. Group legal department.  In this role, he manages the legal activities performed by 170 in-house legal counsel in over 100 countries and serves on the Group Legal Committee, consisting of 10 General Counsel supervising the global team of 550 lawyers in the Total Group. Furthermore, Jonathan Marsh also serves as Vice President International Affairs and on the Board of Directors of the French In-house Counsel Association (Association Française des Juristes d’Entreprises – AFJE).

Giovanni Cerutti is SVP General Counsel at the leading IT services provider NTT DATA in the EMEA region since 2012. Within the scope of his role, he is focused on legal & compliance matters, including data privacy and IP, protecting Group’s values and assets to benefit all stakeholders. A versatile and flexible legal manager, Cerutti oversees legal & compliance in numerous legal systems, all of which present challenges through different languages, cultures, and different statutory routes.
